About this event

Students often leave Law School without having studied unjust enrichment. Practitioners and judges are often wary of the subject. The High Court has cast doubt on its status in Australian law. Yet unjust enrichment stands alongside contract and tort as a third branch of private law, and has great practical importance. This seminar will provide an overview of the elements of a claim in the category of unjust enrichment, its relationship with contract and the available defences. It will emphasise practical matters such as how to plead an unjust enrichment claim.

About the presenter

Felicity is a Senior Lecturer at the Law School of the University of Western Australia, where she teaches and researches in various private law subjects. Felicity has a particular interest in the law of restitution and unjust enrichment.

Felicity is also a barrister at Quayside Chambers, and has a broad commercial practice.

Prior to joining Quayside Chambers, Felicity was a solicitor at King & Wood Mallesons (then Mallesons Stephen Jaques) in Perth, a Judicial Assistant to the then Master of the Rolls, Lord Phillips, in the Court of Appeal in England, and an Assistant Parliamentary Counsel in the English Parliamentary Counsel Office in London. Felicity practiced as a barrister in London for five years and in Sydney for two years.

Felicity holds a Doctor of Philosophy (Law), Master of Philosophy (Law) and Bachelor of Civil Law from Oxford University, and a Bachelor of Laws and Bachelor of Arts from the University of Western Australia.
