We’re back and taking the magnifying glass to some interesting cases

One in particular is an appeal to the South Australian Employment Tribunal by Dial A Tow which appears to extend the duties of end users of plant, essentially requiring a purchaser of plant to conduct its own risk assessment, even where that plant has been supplied by a reputable manufacturer. The Court does acknowledge that “a safety duty may be discharged by engaging an independent contractor” but goes on to say “the defendant ought reasonably to have known (because of its experience) about engineering ways of eliminating or minimising the risk by engaging suitably qualified and experienced personnel to provide advice and assistance.”

This begs the question of who is an expert if not an expert supplier????
