'High Court Update: Good Faith in Insurance' with Barrister Darren Ferrari

I﻿nsurance Practitioners,Join Barrister Darren Ferrari for a High Court update on good faith in insurance. T﻿his presentation will include:<ul><li>The relationship between the insurance contract and the duty of utmost good faith;</li><li>The Court’s view of an insurer’s obligations when handling claims; and</li><li>The content of the duty of utmost good faith.</li></ul>A﻿bout your presenter:Darren appears and advises in all areas of commercial, insurance, corporations and contract law. He is committed to working collaboratively with clients to understand their interests and motivations in order to achieve the best possible outcome. Darren has a special interest in the following commercial areas of practice:Insurance mattersDarren accepts briefs in indemnity disputes in all insurance lines. He has particular experience in liability insurance disputes.He is also commonly briefed in disputes in which indemnity has been granted to policyholders and has a special interest in the effective management of the relationships between insurers, policyholders, and their representatives. This part of Darren’s practice extends from commercial to common law disputes.Darren also has extensive knowledge of the regulatory environment in which insurers operate. He is able to clearly advise both insurers and policyholders of their respective rights and obligations.Contract DisputesDarren is regularly briefed to review commercial contracts (including insurance contracts) to advise on drafting and regulatory issues.He is also often briefed in commercial disputes involving complex contractual arrangements, often involving multiple parties and contracts.He has particular experience in interpretation and indemnity disputes.RegulationDarren has experience in assisting businesses in responding to regulatory investigations, including those conducted by the ACCC, ASIC and the ATO. MediationsDarren is an accredited mediator. He accepts briefs to appear as a mediator in matters pertaining to commercial disputes and insurance matters (including common law and professional indemnity/negligence disputes). Darren’s mediation style is facilitative, though he brings his subject-matter knowledge to those disputes. Darren welcomes being briefed directly by corporations to advise on both contentious and uncontentious matters.Adjacent to his practice at the Bar, Darren is currently the President of the Australian Insurance Law Association. He is also a member of International Cycling Executives (ICE) and regularly rides with the ‘Knights of Suburbia’.He holds a Masters in Law from the University of Melbourne and is a sessional teaching associate at Monash University. He has taught in contracts, corporations law, litigation and dispute resolution. He is currently teaching Evidence.
