Don't miss out on our two-part Commercial Contracts Workshop on Wednesday 30 August, where our NECA Legal expert Frank Brown, will guide you through the critical topics of Contract Administration and Payment Recovery. Join us to gain valuable insights and stay ahead of the competition. Workshop Details Date: Wednesday 30 August, 2023 Time: 9.30am - 1.30pm (check-in from 8.45am) Venue: NECA Centre of Excellence, Chullora Cost: $120 NECA Members and $250 non-members (inc gst) Morning tea and lunch provided on the day. This is an interactive, face-to-face workshop and attendees are encouraged to ask questions. Workshop Agenda Part 1: Contract AdministrationWhether you get this right can be the difference to a project making profit or a loss. Don’t get caught out doing additional work for free because variation procedures were not followed or lose the opportunity to claim for delay or delay costs by not following time clauses, or worse, becoming liable to pay liquidated damages. In some cases, contractors can complete additional work and delays are not caused by them but they can end up not being paid for additional work and actually end up paying the Contractor or Client for delays they didn’t cause. The stakes are high so it is important to be in the know.  Part 1 of the workshop will cover: <ul><li>Managing time and delays </li><li>Managing additional costs and work </li><li>Managing payment  </li></ul>Part 2: Recovery of Payment  The better you administer the contract, the better position you put yourself in to recover payment if this is not forthcoming. Utilising the payment claim process under the SOPA Act is always the best option and then it is a question of whether adjudication or court is better. There are a lot of stumbling blocks on this and it can depend on a number of factors. Was a payment schedule received? Is there a written contract? Is it the final payment to be paid?
