On 9 February 2022 the High Court of Australia handed down 2 decisions that increased clarity and certainty for businesses who engage independent contractors. Construction, Forestry, Maritime, Mining And Energy Union &amp; Anor v Personnel Contracting Pty Ltd [2022] HCA 1 and ZG Operations &amp; Anor V Jamsek &amp; Ors [2022] HCA 2 confirmed the importance of the terms in a written contract in determining whether a worker is an independent contractor or employee.
