Criminal Law Practitioners,Join Barristers Paul Kounnas and Liam McAuliffe as they review and analyse key Criminal Law cases from 2021. This session focuses on key points of principle from criminal and quasi-criminal appellate cases, tracks certain developments in the common law with respect to conviction and sentencing appeals, and provides insight to practitioners from other key Court of Appeal and Supreme Court judgments.<h3></h3><h3>About your presenters:</h3><h3>Paul Kounnas:</h3>Paul practises predominantly in criminal law and is regularly briefed in trial and appeal work in the County and Supreme Courts. He holds an Indictable Crime Certificate (ICC) and is on the VLA Preferred Barrister List. Paul welcomes briefs in all indictable criminal matters, both for appearance and advice. In addition to this, Paul is available for private summary crime.Paul has developed a special expertise in the defence of complex sex matters and bail hearings. He also has experience in significant fraud matters, prosecuting one of the largest commercial frauds in Victorian history (the ‘Viking’ trials).Paul has special interest in compensation matters (both under the s85 Sentencing Act provisions and the Common Law) as well as disciplinary hearings in all jurisdictions. He also has a wealth of experience with reviews under the Serious Offenders Act and Crimes (Mental Impairment and Unfitness to be Tried) Act.Recently Paul appeared in the first Murder (that proceeded as a fitness hearing and later special hearing) to run without a jury in the Supreme Court in the case of R v Munze [2020] VSC 272] and (R v Munze (no 2) [2020] VSC 481, (no 3) [2020 VSC 846]. He also appeared in one of the first applications in the County Court under the Omnibus provisions for Judge Alone Trials in the case of R v Carlton [2020 VCC 1272].Paul teaches advocacy at the Victorian Bar (as an Accredited Advocacy Coach) and has previously taught in Papua New Guinea and to various Australian Government instrumentalities. He has lectured on the major changes to the law under the various COVID-19 related amendments as well as issues of evidence and practice.<h3>Liam McAuliffe:</h3>Liam practises in public and administrative law, common law, regulatory law, quasi-criminal, and criminal law. He acts for government and private clients.He provides written advice to State and Federal Government Departments, as well as statutory authorities and bodies in relation to statutory interpretation and administrative decision-making.Public and administrative lawLiam appears both led and unled in coronial inquests, judicial reviews, public interest immunity matters, as well as confidentiality and suppression orders under the Open Courts Act 2013. He also appears in VCAT in public and human rights matters, including matters under the Privacy and Data Protection Act 2014 and the Health Records Act 2014.Common lawHe regularly acts in common law and personal injury matters, including those involving occupational health and safety, institutional abuse, and intentional torts. Liam is regularly briefed in negligence actions relating to health practitioners and legal professionals.Regulatory, quasi-criminal and criminal lawLiam has significant experience in matters under the Serious Offenders Act 2018, and under the Crimes Mental Impairment (Unfitness to be Tried) Act 1997. He is experienced in regulatory prosecutions and in professional disciplinary matters. Liam regularly appears in the County Court and the Magistrates&#x27; Court in criminal matters for both the defence and prosecution.Liam also has a significant interest and experience in terrorism related matters. In Victoria, he has acted for Corrections Victoria in matters relating to Division 105A of the Criminal Code and, in NSW, for the Attorney-General in matters under the Terrorism (High Risk Offenders) Act 2017 (NSW).Prior experienceLiam has over eight years&#x27; experience as a solicitor. Prior to coming to the Bar, Liam was a Principal Solicitor in the Litigation and Dispute Resolution Branch at the Victorian Government Solicitor&#x27;s Office (VGSO). At the VGSO, he specialised in advising and representing Corrections Victoria and the Department of Justice and Community Safety.
