Waiver of Liability

Event: 2024 XLBC Winter Marathon

Date: June 2, 2024

Assumption of Risk: I understand and acknowledge that participation in the Event involves certain risks and dangers, including but not limited to those arising from the terrain, weather conditions, equipment, and actions of other participants or animals attending. I voluntarily assume all risks associated with my participation in the Event.

Release and Waiver: I hereby release, waive, discharge, and covenant not to sue the organizers, sponsors, volunteers, or any affiliated individuals or entities involved in the planning, execution, or promotion of the Event (collectively referred to as the "Released Parties"), from any and all claims, liabilities, damages, losses, or expenses, including but not limited to medical expenses and attorney fees, arising from or in connection with my participation in the Event, including any claims arising from the negligence of the Released Parties.

Responsibility for Dogs: If I choose to bring a dog to the Event, I understand that I am solely responsible for the actions of my dog. I agree to keep my dog on a leash at all times and not to approach another animal without asking for permission first. I understand that if my dog shows aggressive behavior, I may be asked to leave the Event immediately without refund. Zero aggression from dogs or humans is tolerated. I further agree to indemnify and hold harmless the Released Parties from any claims arising from the actions of my dog.

Booth Ownership: If I have purchased a booth for the day of the Event, I understand that I am solely responsible for any activities conducted within the booth and any liabilities arising therefrom. I agree to indemnify and hold harmless the Released Parties from any claims related to my booth or its activities.

Agreement to Follow Rules: I agree to abide by all rules, regulations, and instructions provided by the organizers of the Event. I understand that failure to comply with these rules may result in my disqualification from the Event and removal from the premises.

Medical Treatment: In the event of an injury or medical emergency, I authorize the Event organizers to obtain medical treatment for me, including transportation to a medical facility, if deemed necessary. I understand that I am solely responsible for any costs associated with such medical treatment.

Governing Law: This Waiver of Liability shall be governed by and construed in accordance with the laws of the State of Queensland, Australia. Any legal action or proceeding arising out of or related to this Waiver shall be brought exclusively in the courts of Queensland, Australia.

I have read this Waiver of Liability, fully understand its terms, and voluntarily agree to be bound by them.
