Useful Information:

There will be some hiking over uneven surfaces and off-road style 4WD access, we recommend a moderate level of fitness is required to complete all of the activities. The temperature may very from 0 to 24 °C, and layer of thermal underclothing, hiking boots, weatherproof jacket, gloves and a beanie will be necessary. Hiking poles might be a good idea for anyone unsteady on their feet.

In the event of COVID, we will follow the advice of the Smartraveller Website and refer to the most current local laws available at the time.

Drones are allowed on the tour, but must abide by the local regional rules that govern each locality.

Local SIM cards are easy to set-up and can be purchased at the airport or local supermarket. The SPARK card seems to have the best coverage and the $80 prepaid value pack offer 28 days of coverage with 40GB data and unlimited test & calls to local and Australian numbers.

Power sockets are the same as Australia.

Booking Terms and Conditions


Introduction


Please read the following terms and conditions carefully. You must not make any booking unless you understand and agree with the following terms and conditions. These terms and conditions apply to bookings you make with our consultants (in-store, over phone or by email) as well as online bookings you make on our website. We will rely on the authority of the person making the booking to act on behalf of any other traveler on the booking and that person will bind all such travellers to these terms and conditions. We provide you with Booking & Advisory Services that allow you to acquire a Travel Product from a Third Party Travel Provider. We act as agent for the Third Party Travel Provider. By acquiring Booking & Advisory Services from us, you agree that you have read and accept both these terms and conditions and the terms and conditions of the Third Party Travel Provider relating to the Travel Product. You pay us for providing the Booking & Advisory Services to you. It is solely your responsibility to make yourself aware of the terms and conditions set out by the Third Party Travel Provider.

  • We are solely responsible for Booking & Advisory Services.
  • We charge change fees and cancellation fees for our services.

Prices:

  • Price may change or fluctuate due to the exchange rate (foreign currencies).
  • Prices may include applicable taxes, some taxes may be additional and payable upon arrival.
  • Generally, the price is only guaranteed once paid for in full.

Service guarantees:

Our booking and advisory services come with a guarantee under the Australian Consumer Law that:

  • they will be provided with due care and skill;
  • they will be reasonably fit for the specified purpose;
  • they can reasonably be expected to achieve the desired result; and
  • they will be provided within a reasonable time.

We cannot guarantee the performance of the suppliers.

Bookings are subject to the Third Party Provider Terms & Conditions including conditions of carriage and limits on liability.

The customer is responsible for reading these before finalising the transaction.

If we fail to meet any of these guarantees, you have rights under the Australian Consumer Law.

Travel Agent’s fees:

In most cases, we do not charge fees over and above your product cost, (if a fee will be charged you will be advised in advance of payment) but in case of cancellation and refunds we do reserve the right to withhold commissions plus a service fee associated with time spend on your booking as this covers, office running costs, etc. Please refer to Our Change and Cancellation Fees set out in these Terms and Conditions.

Names Provided for Documentation:

Please check the spelling of all names, that they are correct as per passport prior to payment and documentation. While we have taken great care to check your travel documents, it is important that you review all of the information in the documents including but not limited to, your name, travel dates, and other particulars relating to your travel arrangements. Travel documents include (without limitation) airline tickets, hotel vouchers, tour vouchers, or any other document (whether in electronic form or otherwise) used to confirm an arrangement with a service provider. Failure to check your documents and or there being errors in spelling once documentation has been processed will incur change fees and service fees, and you may be turned away from your travel service.

Travel Insurance:

It is highly recommended that you purchase a comprehensive travel insurance policy at the time of booking to cover any medical and associated costs that you may incur while travelling. You and/or your family will be personally responsible for these costs if you do not have adequate insurance coverage. Our consultants are FSR compliant and can provide recommendations for a policy that suits your needs. It is your responsibility to carefully read and understand your insurer's Product Disclosure Statement.

Disclosure Authorisation:

In the event of a natural disaster or other emergency occurring in a country where you may be travelling, we may disclose the details of your itinerary and contact information to the relevant authorities.

Passports and Visa Requirements:

All travellers must have a valid passport with at least six months validity beyond the intended stay. Some countries require a longer validity. If you are a permanent resident travelling on a foreign passport, you must hold a Resident Return Visa to re-enter Australia. It is recommended that you check the entry requirements, including all visa requirements, of the countries you plan to visit or transit with the relevant embassy or consulate.

Health Requirements and Vaccinations:

Certain countries may require specific vaccinations or medical precautions. It is recommended that you consult with your doctor or specialist vaccination clinic before your travel. General health advice for your destination is also available on the Department of Foreign Affairs and Trade website: www.smarttraveller.gov.au.

Change and Cancellation Fees:

Subject to your refund and remedy rights under the Australian Consumer Law, the following change and cancellation fees apply to all bookings, including those made online or with a consultant:

Airfare Changes and Cancellation:

Each fare within your itinerary has unique rules and restrictions:

  • If a fare has an airline change fee, the highest fee applies to each traveller.
  • If a fare does not allow changes, no changes are permitted to any flight.
  • If a fare is non-refundable, all flights are non-refundable, excluding Trans-Tasman international flights.

Refer to the “Penalties” section of each fare for all rules, which can be found in the Fare Rules section of your flight summary. The total cost of changes will depend on the airline change fee, fare and tax differences, and applicable fees.

Changes to Domestic/Trans-Tasman bookings will incur a fee of $30 per passenger per booking, in addition to supplier fees.

Changes to International bookings (excluding Trans-Tasman bookings) will incur a fee of $50 per passenger per booking, in addition to supplier fees.

Cancellations to Domestic/Trans-Tasman bookings will incur a fee of $75 per passenger per booking, in addition to supplier fees.

Cancellations to International bookings (excluding Trans-Tasman bookings) will incur a fee of $200 per passenger per booking, in addition to supplier fees.

For international and cruise bookings only, a fee of $200 per passenger per booking will apply, in addition to supplier fees, transaction fees, and exchange rate differences.

If you choose to keep the full amount of your booking on file for future travel, we will waive the cancellation fees. Please note that supplier cancellation fees may still apply.

Cancellation and Changes Policy:

Bookings that are cancelled after confirmation are subject to the forfeiture of the security deposit, and refunds will be provided according to the following scale: we may refund any amounts that have not yet been sent or committed to suppliers, less administration costs. In addition to this fee, charges made by hotels, tour operators, cruise lines, or other principals may apply. These charges can amount to up to 100% of total land arrangement costs, especially when tours and other arrangements are cancelled within 60 days of departure. Clients should check what additional cancellation fees apply before paying the deposit.

Cancellation Charges for Land Arrangements:

From the time of confirmation to 30 days before the first day of the booking, the full security deposit is non-refundable, along with any non-refundable segments to suppliers. From 29-22 days before the first day of the booking, the security deposit plus 25% of the total balance amount is non-refundable, along with any non-refundable segments to suppliers, transaction fees, and exchange rate differences. From 21-15 days before the first day of the booking, the security deposit plus 45% of the total balance amount is non-refundable, along with any non-refundable segments to suppliers, transaction fees, and exchange rate differences. From 14-0 days before the first day of the booking, and in the case of a no-show, 100% of the total trip is non-refundable, along with any non-refundable segments to suppliers, transaction fees, and exchange rate differences.

Cancellation Charges for Cruises:

From the time of confirmation to 46+ days before the first day of the cruise, the full security deposit is non-refundable. From 45-0 days before the first day of the cruise, 100% of the cruise is non-refundable.

Amendment Charges:

No fee applies for the first amendment or to extend an existing booking before documentation is issued, dependent upon supplier policy. Second and subsequent amendments, excluding extensions or additions after confirmations, will incur a $30 fee per booking and per sector or segment. After documentation (vouchers) are issued, a $30 fee will be charged for any changes.

Deposit and Final Payment:

You will be required to pay a deposit or deposits when booking, which will be advised by your consultant. All deposits are non-refundable for changes of mind or cancellations by you (subject to your rights under the Australian Consumer Law). Final payment is required no later than 60 days prior to departure unless otherwise stated. Some airfares or services must be paid in full at the time of booking. Final balance for certain products is required at least 90 days before departure. Late payment may lead to cancellation and/or late documentation. No documentation or travel vouchers will be issued until payment is received in full.

Supplier Change and Cancellation Fees:

Cancelled bookings may also incur supplier fees, which can be up to 100% of the cost of the booking, regardless of whether travel has commenced. Supplier fees may also apply where a booking is changed and when tickets or documents are re-issued. Where a supplier cancellation fee is incurred due to a booking change or cancellation, you agree to indemnify us for the amount of that fee. Where you seek a refund for a cancelled booking for which payment has been made to the supplier, we will not provide a refund to you until we receive the funds from the supplier, refund amounts will be minus supplier fees, transaction fees, exchange rate differences, and admin fees (which may take up to 12 weeks dependent upon the supplier processing time). We highly recommend that you obtain travel insurance to cover yourself in the event of a cancellation.

Payment:

A deposit or deposits are required upon booking and are non-refundable for cancellations or changes of mind (subject to Australian Consumer Law). Final payment is due no later than 60 days prior to departure unless otherwise stated. Late payment may result in cancellation and/or delayed documentation. Some products may require full payment at the time of booking or at least 90 days before departure. No documentation or travel vouchers will be issued until payment is received in full.

Credit Card and Debit Card Payments:

Credit card surcharges of 1.8% for Visa, 1.8% for MasterCard, and 2% for American Express apply when paying by credit card. Debit card surcharges of 0.50% for debit card Visa and 0.50% for debit card MasterCard apply when paying by debit card. You authorise us to charge all fees incurred in relation to the services provided to the credit card or debit card designated by you. If payment is not received from the card issuer, you agree to pay all amounts due immediately upon demand.

Cash Payment Limit:

Federal legislation from 1 January 2020 prohibits cash payments of $10,000 or more per booking, including multiple payments totalling $10,000 or more. Cash payments of less than $10,000 per booking are accepted.

Taxes:

Airline taxes are subject to change and are confirmed at the time of issuing airline tickets. Local taxes may also apply at some airports.

Refunds:

No refund is available for cancellations after travel has commenced or for any unused services. Any valid refund payable will be made net of applicable fees and charges, including merchant transaction fees and cancellation charges levied by either the travel provider or third parties.

Refunds for Travel Products are subject to the terms and conditions agreed with the Third Party Travel Provider. We will provide a refund once we have been reimbursed by the Third Party Travel Provider, subject to these terms and conditions, including the application of any cancellation fees.

Where refunds for unused services are allowed, a service fee may be charged by the Third Party Travel Provider against the value of the refund. Please ensure you include all relevant documentation when requesting a refund. Note that airlines may take 60-90 days to process a refund.

No Show:

If you fail to check-in or otherwise do not use a booked Travel Product, including flights and accommodation, you will not be entitled to any refund.

Liability:

We are responsible for providing you with booking and advisory services, and we are liable to you for any breaches of our obligations. We act as an agent for various travel service providers and book travel services on your behalf. We carefully select reputable service providers, but we have no control over or liability for the services provided by them. Any legal rights you have in connection with the provision of travel services are against the specific provider and not against us, unless the problem is caused by our fault.

We are not liable for any direct or indirect losses or damages suffered by you or anyone else in connection with the delivery or non-delivery of the travel product by the third-party travel service provider, or any act or omission of third-party travel providers or other third parties. However, we do not intend to exclude or restrict the application of consumer guarantees under consumer protection laws.

We are not liable for any injury, damage, loss, delay, additional expense, or inconvenience caused directly or indirectly by the acts or omissions of third-party providers, force majeure, or any other event beyond our control. Our liability will be limited to the extent permitted by law, including any relevant international conventions, and is subject to your rights under the Australian Consumer Law.

Force Majuere:

Neither party will be held liable for any failure or delay in fulfilling their obligations under this agreement due to circumstances beyond their reasonable control. These circumstances may include acts of God, accidents, riots, war, terrorist acts, epidemics, pandemics, quarantines, outbreaks of infectious diseases or public health crises, civil commotion, communication breakdowns, natural disasters, governmental acts or omissions, changes in laws or regulations, national strikes, fires, explosions, or a general lack of availability of raw materials or energy.

Please note that force majeure does not cover financial distress, changes in market conditions, or a party's financial inability to fulfil their obligations.

If a force majeure event occurs, the customer will be subject to the terms and conditions of the supplier.

For any special requirements you may have for your travel arrangements, such as specific meal requests, seating preferences, room type, or disabled access, please consult your travel consultant or contact us directly.

Travel documents, including airline tickets, hotel vouchers, and tour vouchers, are subject to certain conditions and restrictions. These may include being non-refundable, non-changeable, and subject to cancellation or amendment fees. Travel documents are non-transferable. It is important to carefully review your travel documentation and inform us immediately of any errors in names, dates, or timings. If you booked with a consultant, it is your responsibility to collect all travel documents from us before your trip. Typically, travel documents are available for collection approximately two weeks prior to departure, but this may vary depending on your specific arrangements. If you booked online, please print and retain the travel documents provided by the website or in a follow-up email.

Schedule Changes:

We recommend checking with your airline 24 hours before your flight to confirm the scheduled departure time.

Frequent Flyer:

Please provide your frequent flyer membership details when booking with us. We cannot guarantee that the supplier will credit you with points for your booking.

Privacy Policy:

We protect your personal information and handle it according to our Privacy Policy, available online or in-store. By giving us your personal information, you agree to our Privacy Policy, which allows us to collect, use, and disclose your personal information. We may disclose your personal information to overseas recipients, including travel service providers, related entities, and service providers who work for us. We will only disclose your personal information to these persons in connection with facilitation of your travel booking and/or to enable the performance of administrative and technical services by them on our behalf.

Monies Received:

All monies paid by you to us are held in a Trust account and paid out to the travel service providers. We prepay all travel services and do not hold onto any monies paid for travel services.

Governing Law:

In case of any dispute between you and us, the laws of Australia will apply. You agree to the exclusive jurisdiction of the courts of Australia and waive any right that you may have to object to an action being brought in those courts.

Your Obligations and Warranties:

By using our services, you agree to the following:

(a) You are at least 18 years old and have the authority to enter into a contract with us and the Third Party Travel Providers.

(b) The information you provide is true, accurate, current, and complete.

(c) You will update your information as necessary to ensure its accuracy.

(d) You have read and understood our terms and conditions.

(e) You have read and agree to the terms and conditions of the third-party suppliers.

(f) You are responsible for verifying the accuracy of all documents provided to you.

(g) You will contact the airline at least seventy-two (72) hours before your travel.

(h) You have accessed the Smart-traveller website for destination-specific information.

(i) Passport/visa and other required identification documents are your responsibility.

(j) You have considered obtaining comprehensive travel insurance.

(k) You will use our services in compliance with these terms and conditions and will not engage in any unlawful activities or defamation.

Product Descriptions:

The descriptions on our website are based on information provided by hotels and suppliers. Facilities included may change at any time. The standard of accommodation and services is based on various factors and is indicative of a certain rating, but we are not responsible for the actual standard or rating. Hotel ratings may vary from Tourist Office ratings and are suggestions provided by industry local authorities or our representatives.

Last-Minute Bookings and Personalised Itineraries:

For last-minute bookings within 21 days of departure and clients requesting a personalised itinerary, we have certain requirements to ensure the legitimacy of the booking and to protect our efforts.

Last-Minute Bookings:

To secure your last-minute booking, we may need to work outside regular hours and make international calls. Therefore, a $50 deposit is required at the time of your request. This deposit confirms your genuine interest in the booking and helps us prevent customers from obtaining information and then booking directly elsewhere. As a travel agency, our income relies on commissions from bookings made through our company.

Personalised Itineraries:

As Croatian Specialists, we take pleasure in crafting unique itineraries for our clients. We offer advice on destinations, dining, attractions, and the ideal duration for each area based on your interests. We are also open to researching additional requests to enhance your holiday experience. To limit the time spent on clients who choose not to book with us, we have implemented a small upfront deposit policy. This deposit ensures your request is genuine. If we cannot find suitable accommodation based on your requirements, we will fully refund the $50 deposit. We appreciate your understanding as we believe in fair compensation for our work.

To our clients outside of Australia, we also require a $50 upfront deposit to ensure genuine bookings and to protect our efforts from being used for personal gain elsewhere. We enjoy working with overseas clients who genuinely wish to utilise our services.

Booking Requirements:

All bookings made within 21 days of the first segment require a $50 deposit per booking.

Payment in full must be made within 2 business days of confirmation.

The $50 deposit will be deducted from the final payment when you complete your booking.

If the requested products are unavailable and we cannot offer a suitable alternative, we will refund the $50 deposit. The deposit is non-refundable if you choose not to finalise the booking for reasons other than non-availability or a change of mind.

For bookings made 7 days or less before the first segment, an additional $50 booking fee may apply, in addition to the immediate deposit. Single Supplements:

We aim to keep single supplements for solo traveler as low as possible to ensure fairness. We believe that solo traveler should not be penalised for requiring single accommodation.

Consumer Claims:

If you encounter any issues during your trip, please contact the company responsible for that service (e.g., transfer/hotel/tour) using the phone number provided on your voucher. If you are not satisfied with their response and wish to make a claim, you must do so in writing to us or the Travel Agent who made your booking within 30 days of the incident. Claims made promptly are essential to avoid delays or rejection by the service providers.

The travel agency does not authorise employees of any overseas supplier to promise refunds to clients for unused services. In addition, the agency and its associated representatives overseas will not accept responsibility for nor approve requests to pay for additional charges for extra services requested or made by clients and not included in the basic prices stated on the website. It is the client's responsibility to settle these charges, if any, before departure. This includes any parking fines or parking fees incurred when a rental vehicle is used, or any minibar used or additional meals requested.

Prices are subject to change based on fluctuating currency exchange rates and are quoted in the local currency, inclusive of applicable taxes, unless otherwise indicated. Details of hotels and holidays described on the website may have changed since its release, and changes in exchange rates or airline taxes and other factors may also affect the price of particular holidays. Clients are advised to check with the travel agent whether any changes have occurred in the price or itinerary before booking and when the balance is due. Special offers can be withdrawn at any time.

The prices quoted by the agency are subject to change without notice in the event of unforeseen circumstances such as fluctuation in exchange rates and/or increases in land and airfare costs, airport charges or government taxes. No surcharges in respect of cost or currency deterioration will be made once full payment for the arrangements has been received. This guarantee does not apply to any taxes, charges, or levies imposed by any government or their agencies or to errors or omissions. Itineraries are subject to alteration if airline schedules are amended, a tour is cancelled by the operator for any reason, or other conditions require it. If, in the unlikely event that the agency has to cancel the booking because of insufficient numbers booked or because of events outside its control, the agency will, if possible, offer an alternative tour or arrangements of a similar standard. If the alternative is not suitable for the client, the agency will endeavor to refund in full any monies already paid for that particular tour or arrangement once refunded by the supplier/provider.

The agency makes every effort to ensure accuracy in hotel information and descriptions, but it is also reliant on the suppliers and hotels giving accurate data. Since hotels are constantly changing facilities and services, the agency cannot be liable for any errors or omissions herein or for any disruption caused by hotel or apartment renovations. If any feature is of critical importance to the holiday, it is the client's responsibility to ask the agency to check whether such features will be available at the time of occupancy at the given hotel. If for any reason the hotel(s) nominated herein is/are unavailable, an alternative will be sought/offered. If, after confirmation, the hotel becomes unavailable, the client will be assigned to a hotel of similar standard.

The travel agency, acting as an agent, sells various travel-related products on behalf of multiple service providers, including transportation and accommodation. The agency's responsibility is to make travel bookings and arrange contracts between clients and service providers. The agency does not guarantee the standard of these services and has no liability for them. Any legal recourse for travel services lies with the specific provider, not the agency.
