Event Details

This short course introduces the main legal principles of water resources management and discusses the legal effect of the National Water Policy reforms that are proposed for Western Australia. Applicable for both lawyers and non-lawyers, participants will also become familiar with the principal legal and policy materials applied in the management of water resources in Western Australia, including insights into the policy guidance for the preparation of the Water Resources Management Bill being drafted by the Government of Western Australia.

There will be five daily sessions (9.15am – 4.30pm) comprising a seminar style mix of lecture and discussion exercises, and cover the topics:

  • the governance framework – institutions and objectives of water resources law
  • water access rights, including Native Title to water resources and the rights of a river
  • water allocation planning, including allocation of environmental water
  • administration of statutory water entitlements, water trading and managed aquifer recharge
  • legal perspectives on mining and water: adaptive management, state agreements and mine dewatering.

The course is led by Professor Alex Gardner, with guest expert presenters from the public and private sectors:

  • Dr Anne Poelina, Traditional Custodian from the Mardoowarra, Lower Fitzroy River in the West Kimberley; Chair, Martuwarra Fitzroy River Council
  • Dan Ferguson, Lisa Mazella and Gary Humphries, Department of Water & Environmental Regulation
  • Dr Ana Manero, UWA Agricultural and Resources Economics
  • Dr Natalie Brown, UWA Law School
  • Daniela Tonon, Daniela Tonon Legal.

The content of the short course aligns with the treatise by A Gardner, R Bartlett, J Gray and R Nelson, Water Resources Law, 2nd edition, 2018 (LexisNexis Butterworths), the first edition of which was described by Justice Curthoys, President of the State Administrative Tribunal of WA, in Ord Irrigation Cooperative Ltd and Department of Water [2017] WASAT 85 as ‘a very useful analysis of water law in Australia’.
