Through the remainder of the Victorian transition period to 29 October 2019, WorkAccord will be presenting workshops specially designed for labour-hire business owners & managers and their "Nominated Officers".

The three-hour workshops are offered in two sessions which cover different aspects of the scheme and the application process. You can book for either session or for both. As allocation is on a first-come-first-served basis, make sure you register early to ensure you get your preferred session.

The Morning Session is dedicated to building a comprehensive knowledge of the core concepts of the Victorian Labour Hire Licensing scheme. You'll get to explore:

  • coverage
  • the contractor management services provisions
  • application to tiered supply arrangements
  • exclusions
  • the "regardlesses" - extensions of coverage
  • who is a worker?
  • the regulatory extensions for cleaning, horticulture, meat & poultry processing
  • prohibitions, including anti-avoidance provisions
  • The fit & proper person and compliance tests (outline)
  • objections
  • conditions

The Afternoon Session is all about preparing an application. You'll get to examine:

  • eligibility criteria - who is prevented from applying?
  • information that you need to support your application
  • the "accommodation trap"
  • the "visa trap"
  • the "worker classification trap" - how to identify the different categories of workers you need to report on (employees v independent contractors v hybrid workers)
  • data matching traps
  • the fit-and-proper-person requirement (detail)
  • "skeletons-in-the cupboard" and what to do about them
  • removing the "dead wood" and some hard conversations you may need to have
  • mutual recognition, interstate licences and "approved schemes"
  • the Authority's discretion to grant a licence even if the application does not satisfy all requirements
  • alternatives to outright refusal
  • licence fees and how they are calculated
  • the question of timing
  • tactical withdrawal

Presenter: Andrew C. Wood Hon FRCSA (Life).

Andrew is a former barrister & solicitor with more than 35 years' continuous practice. He now works as a workforce & employment relations advisor and mediator with WorkAccord and is engaged as a sessional academic to plan and teach QUT's post-graduate Employment Law unit. He has contributed submissions on behalf of RCSA for the Victorian, Queensland and South Australian licensing scheme consultations, as well as the UK's GLAA and Employment Agents reviews and the Western Australian Employment Agents review.
