Description

The emerging trend of underpayments; spanning many years and billions of dollars, systematically threaded throughout some of Australia's largest employers is causing a media storm. Headlines of 'wage theft', 'criminalisation', 'deliberate', 'negligence' and 'epidemic' frequent our screens. However, it is not just those employers exposed as deliberately underpaying employees that are being fined significant amounts. The Fair Work Ombudsman has indicated that it will hold employers to account for breaching workplace laws – even where the employer itself comes forward to admit the breach.

With the spotlight focused heavily on all Australian employers, it is more important than ever that all employers are across Australia's complex and dynamic workplace laws, including the modern award system, as it applies to them, and paying each and every employee correctly.

What will we discuss?

In this seminar, with reference to real life situations, the Employment group will explore issues including:

  • What are underpayments and wage theft?

  • Salary annualisation and the potential risks arising in relation to underpayments

  • Rectification: enforceable undertakings, repayments and penalties

  • Recent case examples, including deliberate and inadvertent underpayments and the treatment of each by the FWO in prosecuting the employer responsible.

Following the presentation, we will have some time for questions and discussion.
