Area of Interest: Litigation

Class action litigation is an established and increasingly important tool of civil procedure. However, it has been subject to recent scrutiny by both the courts and the law reform commissions of Australia and Victoria. This seminar will focus on key developments such as addressing competing class actions, the use of a common fund for awarding a litigation funder’s fee, and the rise of insurers exercising subrogated rights on the plaintiff side of class actions. The seminar will also engage with the future of the class action from the perspective of new causes of action, and possible reforms. We will hear from leading members of the judiciary and professionals about their insights into class actions.

Opening Address - Competing Class Actions – the Judicial response

Topic 1: Common fund orders: Judicial innovation or unlawful acquisition of property

Topic 2: Insurers seeking to exercise subrogated rights on the plaintiff side of class actions

  • Who controls the action?
  • Who controls which aspects of the acion when there is one claim but multiple interests (e.g. home insurer, car insured and uninsured portion of loss)?
  • What the priority of payments are under a settlement?

Panel Discussion: The future of class actions

  • New causes of action including claims addressing privacy, climate change and superannuation
  • The future of popular causes of action such as continuous disclosure
  • Regulation of litigation funders
  • Oversight of legal fees and methods of charging
  • Settlement approval and techniques for protecting group members
