The STEP Victoria Branch invites you to a seminar presented by Dr Philip Bender on Re McGowan & Valentini Trusts [2021] VSC 15.

This seminar explores the trusts issues raised in Re McGowan & Valentini Trusts [2021] VSC 15.  It will provide participants with an opportunity to discuss the case and its implications with counsel that acted in the case.  The case involved some novel trusts issues including the following: 

  • What happens to a trust when it is settled prior to incorporation of the corporate trustee; 
  • Proof of a trust and meeting the Property Law Act 1958 requirements when a property is not in the trustee’s name; 
  • Proof of a trust and meeting the Property Law Act 1958 requirements when there is no written declaration of trust; 
  • Whether a power of amendment can be used to amend itself; 
  • The ability to extend the life of a trust after vesting; 
  • The application of the rule in Saunders v Vautier to amendments of a trust deed; 
  • Trust resettlement when major changes are made to a trust.

SPEAKER | DR PHILIP BENDER, Barrister & Nationally Accredited Mediator

Dr Philip Bender is a barrister and member of Chartered Accountants Australia NZ practising in trusts and estates, taxation and superannuation, and various areas of commercial and property law.  He is the author of Bender’s Australian Stamp Duties published by the Taxation Institute.  In the trusts area, he has acted in numerous disputes and advisory matters involving will and trust deed interpretation, allegations of breach of trust, applications to remove trustees, applications for judicial advice, charitable trusts, superannuation death benefits disputes, and taxation disputes involving trusts and superannuation matters.  He acted as counsel in Re McGowan & Valentini Trusts [2021] VSC 15.
