This session will focus on the practical use of Section 72 of the Building Act 1993, including the circumstances in which an occupancy permit may be cancelled on other grounds, the implications of taking that step, and guidance for Municipal Building Surveyors on when, where and whether this power should be utilised. The presentation will also touch on Section 229J (Confidentiality) in a council context, particularly how to manage requests for updates from councillors acting on behalf of owners or complainants, with a view to supporting consistent and lawful response protocols.
