Division 7A – Pre-1997 loans and pre-2009 UPEs

Division 7A was introduced with effect from 4 December 1997 and in most cases, any loans made prior to its introduction were generally quarantined, although they may still appear on financials today. Despite being “out of sight, out of mind”, these loans should not be ignored and the assumption that Division 7A can’t apply to pre-1997 loans is a risky generalisation.

The introduction of TR 2010/3 brought more big changes, when the ATO announced that UPE’s were “financial accommodation” and would be caught by Division 7A, effective 16 December 2009. Any UPE’s arising prior to this date should also be quarantined on the balance sheet.

With some big potential changes to Division 7A on the way and only a consultation paper released to date, we’re in a state of limbo, especially with regard to pre-1997 loans and pre-2009 UPEs. In this session, Rhiannon will take you back to basics with a brief history of Division 7A, highlight the key issues to be aware of in relation to these loans and UPE’s, and outline how they could be impacted by the proposed changes.
