Course Overview

AbilitySeer’s NDIS Reviews and Appeals Workshops are aimed at community sector employees at any level who are engaging with the NDIA on behalf of their clients.

The course takes attendees from preparing and submitting a persuasive Access Request Form, through the Internal Review Process, and into making an application for review to the Administrative Appeals Tribunal, and negotiating and implementing settlements prior to hearings.

It also covers topics such as Client Interviewing, the NDIS Complaints Process, the role of the Commonwealth Ombudsman, Freedom of Information applications, and Administrative Law Principles.

By the end of the course, participants will be better informed, and more confident in supporting their clients to utilise the review and appeals framework as a means of resolving issues which may arise when dealing with the NDIS.

AbilitySeer emphasise supporting people with disability to actively participate in these processes at all stages through out their training courses wherever possible.

Our very special guest presenter will be Jill Toohey, formerly Senior Member of the Administrative Appeals Tribunal's NDIS Division. Jill's presentation on day 2, will focus on principles of administrative law, and AAT processes, both essential knowledge for anyone seeking review of an NDIS decision in the AAT.In the field of NDIS administrative jurisprudence, there isn't a better mind than Jill's. This is a workshop not to be missed.

Speakers

The workshop features Tim O’Hare, Lead Trainer, AbilitySeer, an expert in NDIS appeals and our very special and eminent guest presenter, Jill Toohey, formerly Senior Member of the Administrative Appeals Tribunal's NDIS Division, who will be making her first public appearance since retiring from the tribunal.

Tim O'Hare
Tim is Lead Trainer at AbilitySeer. Tim's experience spans over ten years working directly with people with disability, including three years with ACT's leading disability, Aged, and Carers' Advocacy Organisation as a Disability Advocate, NDIS Appeals Officer ( ACT and Southern NSW), and as an NDIS Support Coordinator.

Commencing in what was then a NDIS trial site three years ago, Tim came to work exclusively in the area of resolving disputes between his clients, and the NDIA, obtaining noteworthy outcomes for his clients, and bringing an unparalleled level of knowledge and insight to his workshops for participants.

Jill Toohey
Jill's judgment, decision-making, writing and management skills draw on more than 30 years’ experience as a senior member of Commonwealth and State tribunals and as a senior manager of public sector and community organisations. She has brought these skills to diverse areas of law including the National Disability Insurance Scheme, workers compensation, social security, veterans, guardianship and administration, equal opportunity, gender reassignment, vocational regulation, FOI, and refugee and citizenship.

As Chair of the Commonwealth Administrative Appeals Tribunal’s NDIS Monitoring Committee with responsibility for the Tribunal’s NDIS Division, Jill has been at the forefront of NDIS jurisprudence and emerging issues, presiding on hearings, ensuring efficient management of the NDIS caseload, and providing advice and professional development on NDIS law and practice for members, conference registrars and staff of the Tribunal. She is a sought after speaker and has delivered presentations on the NDIS to organisations including the Federal Court of Australia, the Australian Institute of Administrative Law, the Legal Aid Commission of WA and disability advocacy organisations. She is an expert in this important new field.
