A workshop for Aboriginal and Torres Strait Islander Mental Health Professionals

On 27 July 2016, the Aboriginal Legal Service NSW/ACT Limited and UNSW Law Faculty will host a full day workshop for Aboriginal and Torres Strait Islander psychologists and other mental health care professionals who are interested in working within the criminal justice system.

The purpose of the training is to equip participants with an understanding of the laws and procedures relating to the mental health pathways within the justice system and to develop skills in report writing and providing expert opinions in court. The workshop also aims to connect participants to legal services so that Aboriginal and Torres Strait Islander people who are before the courts are referred to culturally appropriate mental health services.

The training focuses on:

  • the relevance of mental illness and cognitive impairments in the criminal justice system
  • an overview of the Mental Health (Forensic Provisions) Act 1990 which relate to diverting mentally ill and clients with mental health conditions from the criminal justice system
  • an overview mental illness and sentencing
  • unfitness to be tried the defence of mental illness

Expert Evidence

  • Section 79 of the Evidence Act: expert opinion evidence
  • an introduction to writing reports
  • the role of the expert witness and giving evidence in court
