Workplace Intensive Training - Managing Workers Compensation

Why should you come?

Workers compensation is hard to manage, involves insurers and the government and has complex legislation and case law that make navigating it as an employer difficult. The four biggest issues in Workers’ Compensations are:

1. When is the employee deemed to be at work and how can you ensure you are not on liability when an employee at home-but not working, working away from home and not working or participating in a non-work activity supported by work but not working;

2. The practical and legal steps to having claims rejected or terminated , especially strategic stress claims made to avoid performance management;

3. How do I manage employee performance when on workers’ compensation; and

4. Premium management – both in terms of a financial commitment and people resources. We will help you understand the factors that impact premium and the strategies your business can put in place to control those factors.

What will the training involve?

  • Avoiding workers’ compensation liability for non-work activity;
  • How can you ensure rejection or termination of claims (and employment out of the ‘obligation period’);
  • How to terminate or make redundant an employee who is on workers’ compensation;
  • What causes increases in premium and what your business can do to limit the cost of a claim;
  • Understanding the law around stress claims and when management action is ‘reasonable’ - what you must do and what not to do when managing an employee;
  • How to limit common law risk; and
  • How to proactively manage your workplace using all elements of workplace law (employment, safety, discrimination and privacy – as well as workers’ compensation law)

How will the training be delivered?

This training will be delivered via a Zoom meeting format. A meeting link will be sent 48 hours before the training event.
