In a time of rapidly increasing litigation costs, pressure from courts and statutory requirements for lawyers to assist clients to resolve disputes cheaply and expeditiously, this interactive workshop will equip you to meet clients’ expectations and deal with the problems and issues that arise in alternative dispute resolution.

  • Choosing the right procedure and the right time for ADR
  • Quick and dirty alternatives to mediation
  • Mediation – when one day is not enough
  • 10 reasons why ADR fails
  • How to best advocate for your client
  • Discovery and production of documents
  • Dealing with unrepresented parties and difficult opponents
  • Is it better to have a court order for ADR?
  • Deception and bluffing – are you complying with the Conduct Rules? And ethical decision making.

Facilitator:
Angela Bowne SC

Angela Bowne SC has practised at the NSW Bar since 1986 and was appointed Senior Counsel in 2003. With substantial expertise in litigation in various areas of law and in alternative dispute resolution, she now concentrates on strategies for resolving disputes, advice and ethics.

She is an accredited mediator under the National Standards and a BarADR approved expert determiner and arbitrator. She is a member of the mediation panels of IP Australia, the World Intellectual Property Organisation, Supreme Court of NSW, District Court of NSW, NSW Bar Association and a member of the dispute resolution panel for APRA AMCOS.

If you cannot attend one of our seminars, you are able to transfer your ticket to another person from your firm. However, you must notify CLE with the replacement's contact details at least 48 hours before the event.
