About this event

In 2018 the Limitation Act 2005 (WA) was amended to abolish limitation periods for child sexual abuse. At the same time the Civil Liability Act 2002 (WA) was amended to allow claims to be made against institutional defendants in child sexual abuse cases. Similar legislation has been enacted in all other Australian jurisdictions in the wake of the 2015 Royal Commission into Institutional Responses to Child Sexual Abuse. This presentation will examine the pre-2018 law, the legislative provisions in Western Australia, the differences between the legislation in Western Australia and the other jurisdictions, and the latest case law on the new provisions.

About the presenter

Emeritus Professor Peter Handford taught at the UWA Law School between 1977 and his retirement in 2016. Between 1983 and 1998 he was Director of Research at the WA Law Reform Commission, and was the author of various reports including the 1997 Report on Limitation of Actions. He is the author of Limitation of Actions: The Laws of Australia (2017 and online) and Tort Liability for Mental Harm (2017).
