Description

CPN Legal Masterclass with Leslie Glick QC

Asset protection – do you know the exposure?

Asset protection is always a hot topic.

In essence, it is an attempt to separate the beneficial ownership of assets from the risk of business failure and personal exposure.

Lawyers and accountants are regularly asked to give asset protection advice. Many asset planning structures have limitations and there are no guarantees that any one particular type of structure will provide the desired protection.

The consequences of getting asset protection advice wrong can be drastic for the client and the advisor and often play out decades after the advice was given.

After decades of attacking asset protection strategies across some of Australia’s most high-profile personal bankruptcies and corporate failures, the insolvency team at Pitcher Partners is uniquely placed to share their insights into what works well and what doesn’t work at all.

In this session you will hear from one of Australia’s pre-eminent barristers, Leslie Glick QC and two of our partners, Andrew Yeo and Innis Cull who will unpack and explain asset protection in detail.

Key takeaways:

  • The 'clawback' rules that apply in bankruptcy
  • Asset protection and superannuation
  • Family law and bankruptcy
  • Trusts and the trust-busting provisions of the Bankruptcy Act 1966.

Leslie Glick QC is a Queen's Counsel at the Victorian Bar practising predominantly in the areas of commercial, equity, family law and property disputes. He graduated from the University of Melbourne with First Class Honours and was awarded the Supreme Court Prize. He spent some years as a lecturer in equity and taxation law both in Melbourne and at London University.

He has had extensive experience in Family Law cases appearing both in the trial and appellate divisions of the Family Court of Australia, as well as appearing regularly in the Federal Court of Australia and Supreme Court and Court of Appeal in large and complex commercial and property related cases. He has appeared in test cases in the High Court and also in the Privy Council. He has also extensive experience as a mediator in each of these areas.
