The Secure Local Jobs Code Branch will host industry briefing sessions until May 2022 to help industry prepare for the new Ethical Treatment of Workers Evaluation requirements that took effect on 1 February 2022.

Changes that took effect 1 February 2022

From 1 February 2022, the Government Procurement (Ethical Treatment of Workers Evaluation) Direction 2021 was taken into effect. The direction supports the ACT Government objective to use our purchasing power to promote the highest standards of safe and ethical workplace behaviour, and aligns with the Territory’s Procurement Values.

Ethical Treatment of Workers Evaluation

The changes introduce the Ethical Treatment of Workers Evaluation for all ACT Government procurements that are:

  • subject to the Secure Local Jobs Code,
  • valued at over $200,000, and
  • conducted via public tender.

The Ethical Treatment of Workers Evaluation uses the Fair and Safe Employment Criteria to assess the Tenderer’s ongoing compliance with their Secure Local Jobs Code obligations, including Labour Relations Training and Workplace Equity Plans, and whether the Tenderer presents a reputational risk to the ACT Government.

Industry will be required to submit a Fair and Safe Employment Criteria Response Declaration as part of the Tender submission. This is in addition to the existing requirement to hold and maintain a Secure Local Jobs Certificate.

The Secure Local Jobs Branch will be conducting the Ethical Treatment of Workers Evaluation and then making a recommendation to the Procurement delegate as to whether the Tenderer should proceed in the procurement process.
