Topic 1: Updates from the Fair Work Commission

Topic 2: Workplace investigations - Tips for employers
This session will cover some of the complex issues faced by employers when managing workplace investigations including:

  • When is it appropriate to suspend a respondent to an investigation?
  • What information are you obliged to provide to respondents to investigations?
  • What's the best way to manage changes in the scope of investigations?
  • Guidance from recent decisions of the Fair Work Commission

Topic 3: Accessorial Liability under the Fair Work Act 2009 (Cth)

Topic 4: Engaging workers: contractor, casual or permanent employee?

  • Categorising workers for the purposes of the Fair Work Act and other industrial legislation
  • The Full Court’s recent decision in Workpac v Skene [2018] FCAFC 131, confirming that a mineworker treated as a casual employee was in fact permanent and entitled to paid leave
  • A review of recent Court and Tribunal decisions setting out when workers will be considered employees rather than contractors
  • The consequences of these decisions for practitioners, employers and employees.
