Is your business aware of its obligations under the sweeping changes to Data Privacy laws both here in Australia and in Europe?

At home, the new Notifiable Data Breaches (NDB) scheme applies from 22 February 2018 to all entities which are bound by and which hold personal information under the Australian Privacy Act. Amongst other things, the NDB will require entities to assess and report any eligible data breaches.

The European General Data Protection Regulation (GDPR) will come into effect on 25 May 2018 and will affect every organisation which does business in the EU or handles personal information of EU citizens in any manner. While it may seem far removed from South Australian shores, the GDPR contains some new, ambitious, far-reaching and onerous rules on the use of personal data.

Business SA, in conjunction with partners Piper Alderman, CQR and HTS Consulting, Is presenting a seminar on the NDB scheme and the GDPR, to inform South Australian businesses of how critical data safety is and what you can do to prepare yourself.

The risks of being unprepared could be costly. The penalties for non-compliance can be significant and could include fines of up to 4 per cent of worldwide turnover. Regulators have already signalled that they intend to aggressively pursue fines and actions for companies found breaching compliance.

As part of our Business Basics series, Business SA is hosting a panel discussion on 27 February at 5.30pm, which will cover:

  • The important changes to the Australian and the EU legislation
  • The practical implications on your day-to-day business operations
  • Protecting your data with cyber security


The session will be followed by networking, drinks and nibbles.

Phil Kernick - CQR

Phil is the Chief Technology Officer and co-founder of CQR. Established in 2004, CQR is the largest independent information security consultancy in Australia and has built its international operations through offices in the UK and USA.

Phil believes that information security is one of our greatest concerns. It is his passion to help businesses, associations, governments and individuals understand information security so that they can make informed decisions and mitigate risk.

Phil is a regular speaker at information security conferences and industry events. His opinion on cyber incidents and current trends is often sought by the media industry.

Phil has an extensive knowledge and experience of the financial, utility, and defence market segments where he has conducted numerous security and application reviews, developed security audit programmes, and assisted clients to maximise the value of their information assets though effective security strategy and architecture.



Damien Hocking - HTS Consulting

Damian has over 20 years IT experience working in Investment Banking, ASX 200 & Fortune 500 companies both in Australia and the United Kingdom. As a Principal Consultant at HTS Damian provides Software Testing, Change Management, Process Mapping, Business Analysis and Training services to a client base across a diverse range of industries. Damian deals with the practical implications of GDPR & NDB on businesses and the creation of correct processes and procedures to address the regulation’s requirements.



Jen Tan - Piper Alderman

Jen is a senior lawyer in Piper Alderman’s Corporate division. Jen has broad experience and expertise in Corporate and Commercial matters including contracts, corporate governance, corporate structuring, compliance and risk management, insurance, M&A, capital raising, financial services, and general corporate matters. Jen also has specific expertise in cyber security matters, and advises clients across different industries on various matters, including how they can be “cyber security ready” by talking to their boards and management about legal obligations and duties, and assisting them to review their internal procedures, draft statements and policies, review and update their contracts and review their insurance policy. Jen also acts for a number of IT companies including cyber security experts.



David Spear - VUCA (Facilitator)

David Spear is the former State Director of the Australian Institute of Company Directors, Chairman of Tyre Stewardship, NED of Unity Housing, Chairman of the Free Throw Foundation and a Director VUCA Board Consulting. He is a Fellow of the AICD and an Alumni Member of the Harvard Business School Governance program.
