Area of Interest: Building and construction law

This seminar will examine fundamental issues and recent developments in building and construction practice. Leading practitioners in Construction Law will provide you with practical insights that will assist you with increasing your understanding of this specialist area.

Opening Remarks on the Technology and Construction list

Topic 1: General building issues

  • Building disputes litigation and arbitration
  • Defects liability period
  • Expert witnesses – roles and reports
  • Professional indemnity claims in construction disputes
  • Trade practices claimsRole of the architect, project manager, site manager, quantity surveyor, engineers and council.

Topic 2: A round up of important Security of Payment cases in 2018
Cases will include those examining:

  • Whether an adjudicator’s determination can be set aside for an error of law;
  • The High Court’s views on ‘paid when paid’ provisions;
  • The requirements of Supporting Statements;
  • The requirement for an Adjudicator to provide reasons; and
  • Whether an insolvent company can engage the Act.

Topic 3: Delay and disruption in construction projects

  • Basic principles in respect of time for performance and completion under construction contracts
  • Various methodologies for assessing claims for additional time and disruption – the critical path, concurrency and other matters
  • Quantifying costs of delay and disruption – what might be claimed; contract terms and / or loss and damage
  • Preparation in respect of claims for delay or disruption – factual and expert evidence.
