Join us live in the Brisbane Spartan Arena to watch elite teams of friends, families and co-workers join forces, pushing each other to their mental and physical limits.

AUSTRALIAN SPARTAN AUDIENCE TERMS & CONDITIONS

These Audience Terms & Conditions set out the terms and conditions for participating as an audience member in Australian Spartan: Ultimate Team Challenge (the ‘Program’). The Program is being produced by Matchbox Eureka One Pty Ltd (the ‘Producer’) for Seven Network (Operations) Limited (the ‘Seven Network’).
Consent & Release The audience member consents to participate in the Program on the terms and conditions set out in this document. The Producer may film and record the audience member in any media in connection with the Program (a Recording) and may electronically store, reproduce, perform, publish, communicate, adapt and exploit any such Recording in connection with the Program. The Producer has the right, in connection with the Program, to: (a) edit, modify, add to and/or delete material, juxtapose any part of a Recording with any other part of the same Recording, another Recording or other material, change the sequence of events and make any other changes to a Recording or the Program that it deems appropriate; (b) exploit and authorise others to exploit any Recording in the Program or in connection with the promotion of the Program in all media now known or later brought in
to existence throughout the universe in perpetuity (without further payment); and (c) use the audience member’s name, likeness, voice and biographic material in the Program. The audience member acknowledges that: (a) the Producer is not required to include any audience member in the Program (b) the Producer is not obliged to accord the audience member with any form of credit in the Program; and (c) the audience member is not an employee of the Producer nor entitled to any payment, compensation or benefits in respect of his or her participation in the Program except as expressly agreed in writing with the Producer.

Confidentiality
The audience member will keep confidential and will not disclose any confidential information of any kind concerning the Program (including information about the competition results and events contained in the Program) or relating to the business of the Producer (‘Confidential Information’), unless and until such Confidential Information is disclosed in the broadcast or other communication of the Program, is in the public domain, or disclosure is authorised in writing by the Producer. This includes disclosure through social
media. Any photography, filming or recording by an audience member – including on a mobile device – is strictly prohibited.

Conduct & Ticket Conditions
The audience member’s participation in the Program is at the sole discretion of the Producer, the Producer may deny the audience member admission to the filming location or may require that the audience member leave the filming location for any reason whatsoever, including a breach of these Audience Terms & Conditions.
The following conduct rules apply:
a. the audience member must be at least seven years old (although the Producer may make an exception prior to filming for family and friends of participants competing in the Program);
b. anyone under eighteen years old must be accompanied by a parent or guardian and parents or guardians are responsible for the conduct of their children;
c. the audience member must follow all directions or instructions of the Producer and its personnel in connection with the Program, including any directions given at the filming location, or safety directions;
d. the audience member must not be intoxicated and must not bring any alcohol, prescription drugs or prohibited
substances to the filming locations;
e. the audience member must not create any adverse affect on the production of the Program;
f. the audience member must not engage in any disruptive or offensive conduct unsuitable for broadcast television;
g. the audience member must be appropriately dressed; and
h. the audience member may not be allowed to bring any cameras, photographic or filming equipment (including mobile devices with those capabilities) to the filming location;
i. audience members may be required to submit to a search before being allowed entry to the filming location.
j. By attending the recording, I agree to be contacted by That’s The Ticket Pty Ltd via my registered email for
other audience opportunities. I understand that I can unsubscribe from these emails at any time.
The following ticket conditions apply:
a. any ticket issued by the Producer is for the time and date specified, is not transferrable and may be revoked by the Producer in its sole discretion;
b. a lost, stolen, damaged or destroyed ticket may not be replaced by the Producer;
c. the Producer will not be liable for any losses incurred by an audience member as a result of the cancellation,
rescheduling or relocation of the filming of the Program or any decision to deny admission of the audience member to the filming of the Program, including any travel and accommodation expenses.
The Producer may provide the audience member with its further requirements and information on travel to and from the filming location; the audience member’s required period of attendance; or such other matters as may be necessary or convenient in connection with the production of the Program, and the audience member agrees to comply with all such additional requirements.

Intellectual Property & Privacy
The audience member acknowledges that the Producer will be the sole owner of all rights, title and interest (including copyright) in and to any Recording and the Program. The audience member assigns to the Producer all existing and future intellectual property rights (including copyright) in and to any Recording, any material created by the audience member for the Program, and any material created as a result of the audience member’s participation in the Program. The audience member will not use any name, logo or trade mark relating to the Program or of the Producer without the prior written consent of the Producer.
The audience member consents to the Producer’s collection of his or her personal information for the purposes of the Program and to the Producer dealing with the audience member’s personal information as set out in the Privacy Collection Statement below.

Liability
The audience member acknowledges that his or her participation as an audience member in the Program is at the audience member’s own risk and that the Producer will not be liable for any loss or damage incurred by the audience member in connection with their participation in the Program. To the fullest extent permitted by law, the audience member releases the Producer from any and all claims, actions, damages, liabilities, losses, costs and expenses of any kind (including, without limitation, legal fees and costs), arising out of, resulting from, or by reason of their participation in the Program. The audience member specifically acknowledges, without limitation, that the foregoing release applies to any action for defamation, invasion of privacy, misleading and deceptive conduct or infringement of intellectual property rights that may arise from the audience member appearing in the Program. The rights granted to the Producer under these Audience Terms & Conditions cannot be withdrawn and may be freely assigned or licensed by the Producer. The Participant’s sole remedy in respect of the Program shall be an action at law for damages (if any) and the audience member waives any right to injunctive relief or to restrain or interfere with the exploitation of any Recording or the Program.

Contractual Terms & Acceptance
The audience member has not relied on any representations or warranties of the Producer in agreeing to be an audience member for the Program. In particular, the audience member acknowledges that they will not have any right to appear in the program or to participate in the Program other than as an audience member. These Audience Terms & Conditions are governed by the laws of New South Wales, Australia. Any dispute arising under these Audience Terms & Conditions will be determined by courts exercising jurisdiction in New South Wales. In these Audience Terms & Conditions, the ‘Program’ includes any and all parts, episodes, copiesn and versions and future series of the Program, and includes any ‘making of’ and ‘behind the scenes’ films and any promotional films, film clips and stills, and any advertising and publicity material in connection with the Program in all media; (b) the ‘Producer’ includes, Matchbox Productions Pty Ltd, Eureka Productions Pty Ltd, Seven Network (Operations) Limited and their respective affiliates, related bodies corporate, successors and assigns; and (c) a ‘Recording’ includes any edited versions and excerpts made by the Producer in accordance with these Audience Terms & Conditions. The audience member accepts these Audience Terms & Conditions by participating as an audience member in the Program, as a condition of accepting any ticket for entry to the filming location for the Program that may be issued by the Producer or otherwise as a condition of accessing the filming location for the Program. Any parent or guardian accompanying someone under eighteen years old accepts these Audience Terms & Conditions on behalf of that person.

Privacy Collection Statement
The Producer will collect personal information about the audience member for the purposes of the audience member’s participation in the Program and for certain other purposes relating to the production of the Program, including as set out in the Matchbox Eureka Privacy Policy. The Matchbox Eureka Privacy Policy provides more information on how the Producer will collect, use and disclose personal information and for what purposes. It also explains that the Producer may disclose personal information to: its co-production partners, the Seven Network, program sponsors or advertisers, its related bodies corporate, third parties and certain overseas entities. A copy of the Matchbox Eureka Privacy Policy is available online at www.australianspartan.com/privacy.
