Cy Pres Schemes – a Practical Guide

Mr Robert Whiteford TEP, Barrister, QLD Bar
Robert was admitted to practice as a barrister in 1979. He specialises in Trusts, Wills and Estates and is a leading practitioner in those fields. He has appeared in many significant cases in these areas of law.


A practical session: what is it? Why is it needed? Difference between initial impossibility and supervening impossibility; “once in charity always in charity”; what evidence do you need to gather for an cy pres application when there has been an initial failure? A supervening failure? What court documents do you file? When to get the Attorney-General involved – and how do you do that?

Timing: 12:30pm for a light lunch. Seminar from 1:00pm - 2:00pm

Do I have to bring my printed ticket to the event?
No, a list of registered attendees will be at the door.

I RSVP'd that I would attend in person but something has come up - can I attend remotely?
Yes, information about to attend remotely will be sent the day prior to the seminar to all registered attendees.

Will the materials be sent around in advance?
If the speaker provides the materials in advance they will be circulated the day prior to the seminar.

I have a season ticket, do I need to RSVP?
It would be appreciated if you did RSVP if you intend to attend in person. This assists with accurate numbers for catering. As a season ticket holder you will always recieve the recording of the seminar after the event and you are always welcome to attend remotely.
